Welcome to Pawtraits (the “Service”), owned and operated by Pawtraits (“we,” “us,” or “our”). By accessing or using the Service, you (the “User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. Description of the Service

We provide an online platform that allows users to upload images of their dogs and receive AI-generated “humanized” portraits or interpretations (the “Transformations”). All outputs are for entertainment purposes only, and results may vary.

2. Eligibility

  1. You must be at least 13 years old (or older if required by your jurisdiction) to use the Service.
  2. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

  1. Account Creation: You may be required to provide certain personal information (e.g., email address) to access specific features.
  2. Accuracy of Information: You agree to provide accurate, current, and complete information.
  3. Account Responsibility: You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account.

4. User Content

  1. Definition: “User Content” includes the images you upload and any other data or text you submit through the Service.
  2. Ownership: You retain all intellectual property rights in the User Content you upload.
  3. License to Us: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to process, use, reproduce, and display your User Content for the limited purpose of providing the Service.
  4. Prohibited Content: You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, obscene, invasive of another’s privacy, or otherwise objectionable. You also agree not to upload images you do not have the right to use.

5. Privacy

  1. We collect, store, and process your information in accordance with our Privacy Policy.
  2. You acknowledge and agree that your uploaded images may be temporarily stored on our servers or third-party servers for the purpose of generating Transformations.
  3. We will not use your images for marketing or additional AI model training without your explicit consent, unless otherwise stated in our Privacy Policy.

6. AI Transformations & Limitations

  1. Entertainment Use Only: The Transformations generated are for entertainment purposes and may not accurately represent reality.
  2. No Guarantees: We do not guarantee the accuracy, quality, or completeness of any Transformations.
  3. Potential Inaccuracies: By using the Service, you understand that the AI may produce unexpected or distorted results.

7. Prohibited Activities

  1. Hacking and Security Violations: You agree not to circumvent or breach any security or authentication measures.
  2. Misuse of the Service: You agree not to use the Service for fraudulent, illegal, or unauthorized purposes.
  3. Automated Scraping or Crawling: You must not engage in automated data collection (crawlers, scrapers, etc.) unless explicitly permitted.

8. Intellectual Property

  1. Service Content: Except for User Content, all text, graphics, user interfaces, design, logos, and other materials (“Service Content”) belong to us or our licensors and are protected by intellectual property laws.
  2. Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service solely for personal, non-commercial purposes.

9. Disclaimers

  1. “As Is” Basis: The Service (including any AI-generated images) is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.
  2. No Warranty: We disclaim all warranties—express or implied—including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  3. No Liability for AI Outputs: We are not responsible for the content or interpretation of the AI outputs, which may be inaccurate or inappropriate.

10. Limitation of Liability

  1. To the fullest extent permitted by law, we will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.
  2. If we are found liable for any claims under these Terms, our total cumulative liability shall not exceed the amount you paid (if any) to use the Service in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or relating to your use of the Service or your violation of these Terms.

  2. Upon termination, your license to use the Service will immediately cease.

These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of Finland.

We may update these Terms from time to time by posting the updated Terms on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
